Sentence of convicted C.K. transferred to Scotland

A man sentenced for multiple facts on Sint Maarten will now serve his sentence in his home country Scotland. 

On February 13, 2019, the man C.K. was convicted by the Court of First Instance on Sint Maarten to seven years of imprisonment for diamond fencing, bribery of a police officer, provoking forgery, possession and/or distribution of child pornography, sexual abuse of his minor daughter, possession of cocaine and abuse of his landlord. The Court of Appeal acknowledged the judgement on July 14, 2022, and in April 2023 the Supreme Court in The Hague decided that the case became final without any changes. 

During the appeal case, C.K. was allowed by the Court of Appeal to have medical treatment in Scotland. C.K. travelled to Scotland and remained in Scotland ever since. After the request for C.K.'s extradition to Scotland was denied due to medical reasons, the Prosecutor’s Office subsequently submitted a request for the transfer of his prison sentence to Scotland.

The Scottish authorities have confirmed that C.K. is now being held by the Scottish Prison Service and will be treated as if his sentence had originally been imposed in Scotland. C.K. will serve a seven-year sentence starting from September 3, 2024. The time he has already spent in custody - five days in a Scottish prison and one year and 361 days under the custody of the Sint Maarten prison and police authorities - will be deducted from those seven years. 

The Prosecutor’s Office Sint Maarten is satisfied with the resolution of this situation and is grateful to the Scottish authorities for their cooperation in this matter. This case shows that the Prosecutor’s Office of Sint Maarten takes its responsibility to see justice served and sentences are properly executed.
